Welcome to The Andalusian
Thank you for booking your stay, we look forward to welcoming you in sunny Spain! Please find your Holiday Rental Agreement attached, which containts all details about your stay, your holiday home and our general terms and conditions. Should you have any questions, please don't hesitate to get in touch.
IN THESE TERMS AND CONDITIONS
"The Host" shall mean the rental agent The Andalusian.
"The Accommodation" shall mean the holiday house, apartment, penthouse, casa, or villa.
"The Owner" shall mean the owner of the accommodation.
"The Guest(s)" shall mean the person(s) named in the booking form or staying in the accommodation.
THE PARTIES
This Short-Term Rental Agreement (“Agreement”) made on {{reservation_date}} between the following:
Guest: {{guest_name}} (“Guest”), and Host: The Andalusian
THE PREMISES
The Andalusian agrees to lease the described property below to the Guest, and the Guest agrees to rent from the Host:

Hereinafter known as the “Accommodation.”
LEASE TERM
The Guest shall be allowed to occupy the Accommodation starting {{checkin_date}} from {{checkin_time}} and
ending {{checkout_date}} at {{checkout_time}} (“Lease Term”).
BOOKING AND PAYMENT
Upon booking via The Andalusian’s own rental website, you will pay the first 50% of the total rental fee. 7 days prior to your arrival, you will receive a link via email to pay the remaining 50% of the rental fee. If you are renting a holiday home directly via our office, your reservation will be added to our booking system and the same rules will apply as stated above. In case you are renting an accommodation within 24 hours of arrival, you are welcome to pay the full amount at The Andalusian’s office either via a digital link from our booking system or via our payment terminal.
Upon booking via other Online Travel Agencies such as Airbnb, Booking, VRBO, etc. the payment policies are listed at the property listing page.
ACCEPTANCE OF TERMS AND CONDITIONS
The guest(s) has (have) to treat the rental accommodation with the utmost care and respect. The guest(s) is (are) required to report and replace any incurred damages by his/ her/ their fault or that of his/ her/ their company and guest(s). The guest(s) named in the booking confirmation is (are) authorized to agree to these terms and conditions and is (are) acting on behalf of all persons including those substituted or who join the party at a later date. The guest(s) named in the booking confirmation is responsible for ensuring that all persons occupying the accommodation comply with these terms and conditions. The accommodation is strictly for holiday use only and all guests will vacate the accommodation at the conclusion of the period of the holiday. By making the payment you confirm that these conditions are accepted, and you also confirm the accuracy of the details and information given on the booking confirmation.
INDENTIFICATION
As each guest needs to be officially registered at the Junta de Andalucía by us within 24 hours of arrival, along with your booking confirmation you will automatically receive a message asking you to send us a copy of your identity. Please send us a copy of your passport latest on the day of your arrival via email at welcome@theandalusian.co.
OCCUPANCY
Occupancy of the accommodation is limited to the number of persons, as indicated on the accommodation description. The guest(s) agrees not to sublet or share the accommodation except with persons nominated on the booking form, any over occupancy must be agreed with The Andalusian prior to arrival. The Andalusian reserves the right to use all legal means to expel / force out those guests staying in the accommodation unannounced and without the knowledge of The Andalusian.
SELF CATERING
The holiday rental is based on self-catering.
CLEANING
The holiday rental is thoroughly and sustainably cleaned prior to arrival of new guests. Per guest one set of bed linen and a sufficient number of towels will be provided. After check-in, the guest(s) will have a 24-hour deadline to point out to The Andalusian if something is not cleaned properly. All accommodations have a washing machine that can be used for washing of bed- and bath linen and private clothing. Please note that any provided bath towels and bed linen is for use in the accommodation only and should not be taken from the accommodation for use elsewhere. Upon departure, the guest(s) commits to returning the accommodation in a reasonable state, broom-cleaned and everything should be returned to its original location. All garbage must be deposited in the appropriate containers outside the accommodation. In the event that the accommodation is returned in an excessively dirty condition and will require more than the normal cleaning hours, a cleaning fee of € 29,- per hour will be charged and / or deducted from the security deposit.
MAID SERVICE
Maid service is not included for the duration of your stay. Maid service is possible; please ask for it at least 2 weeks before departure by e-mail to welcome@theandalusian.co. The maid service fees can be paid via a digital link via WhatsApp or via the payment terminal located at The Andalusian’s office.
DEPOSIT
For a selection of our accommodations a refundable deposit is required for the compensation of any damage to accommodation or goods in and around the accommodation. The refundable deposit is to be paid in advance by bank transfer. Within one week after departure the refundable deposit will be returned into your bank account once the accommodation and inventory is checked by one of the employees of The Andalusian.
CHECK-IN
Check-in is possible on every day of the week. From Monday to Sunday between 16:00 pm and 22:00 pm local time. You will receive all the necessary instructions on how and where to meet us at your holiday home for an in-person welcome. The cost for an in-person late (after 22:00) check-in during the week, or during weekends are € 49,- ex. IVA.
CHECKOUT
Checkout time is before 10:00 am. On the day of your departure,m you are welcome to leave the keys inside de accommodation on the dining table or otherwise when specified by The Andalusian.
CHECK OF THE ACCOMMODATION
After check-in, the guest(s) will have a 24-hour deadline to point out to The Andalusian the noted defects or damages. At the end of this period of 24 hours the rented goods will be regarded as free from damage at the entry of the guest(s). An employee of The Andalusian will check the accommodation and the inventory after your departure.
CANCELLATION FEES
Free cancellation until the 31st day before arrival.
Cancellation from the 30th day (inclusive) to 0 days before arrival: the cancellation fee is 100% of the totalamount.
Cancellations must be done in writing by e-mail to welcome@theandalusian.co.
COVID-19
If we have to cancel your holiday due to COVID 19, you'll receive a full refund back to your original method of payment. Cancellations are permitted due the following restrictions:
1 ) Negative travel advice applies to the Costa del Sol Spain at the time of departure in the country of residence of the guests.
2) A flying-in ban from the Spanish government.
INSURANCE
The guest(s) is (are) strongly recommended to take out a comprehensive full travel- and cancellation insurance to be fully covered for damage or loss of personal belongings, liability, cancellation, etc. as these cost are not covered by any insurance of The Andalusian and/ or the owner of the accommodation.
KEYS
One set of keys and (if applicable) one remote control for gates and/or garage door, will be handed to the guests for use during their stay. The keys and remote control to the accommodation will be the guests responsibility during the stay, and any costs incurred through loss, damage, or loss of access to the accommodation as a result of losing keys and/or remote control will be charged to guest(s) in full. If keys and remote controls are not being returned to their original collection point the cost will be charged to the guests in full.
LOCKING YOURSELF OUT OF THE PROPERTY
As such if the guest(s) locks himself I themselves out of the accommodation during office hours, a fee starting from € 40,- will be requested to go to the accommodation and let the guest(s) back in. If the guest(s) locks his self / themselves out of the accommodation outside office hours (09:00 - 18:00), guest(s) have to call a locksmith to open the door.
OWNERS PRIVATE AREAS
Any area of the accommodation that is locked, and no keys have been supplied, is private and not for guest(s) use.
RULES FOR SWIMMING POOL(S) AND/ OR OTHER FACILITIES
The use by guest(s) of the facilities belonging to the accommodation such as a pool, gym, etc. are entirely at the user's risk. The Andalusian and the owner of the accommodation do not accept any liability for injury, howsoever caused, as a result of using the communal or private swimming pool/s, gym, etc. Guests are strongly requested not to bring glasses or bottles near the pool area, this is to prevent broken glass from accidentally falling into the pool, please use plastic glasses if drinking around the pool. The guest(s) agrees to respect the rules that are displayed on a sign in the pool area or printed at the Accommodation.
CHILDREN AT THE POOL
IT IS PROHIBITED TO LET CHILDREN MAKE USE OF THE COMMUNAL SWIMMING POOL(S) OR PRIVATE POOL(S) WITHOUT THE SUPERVISION OF AN ADULT.
QUIET ENJOYMENT
The Guest, along with neighbors, shall enjoy each other’s company in a quiet and respectful manner to each other’s enjoyment. The Guest is expected to behave in a civilized manner and shall be good neighbors with any residents of the immediate area. Creating a disturbance of the area by large gatherings or parties shall be grounds for immediate termination of this Agreement.
HOUSE RULES
We kindly ask you to respect our general house rules, which are also shared with your prior to your arrival via our Guest Information manual. Please:
• Do not smoke at the apartment.
• Do not throw parties or events.
• Respect the neighbors and keep noise down after 22:00.
• No unregistered guest staying at the apartment.
• Report any damages or breakage in a timely manner.
• Dispose your garbage at the designated bins outside.
• Turn off the air conditioning / heating when leaving.
• Collect all towels before check-out and leave them at the bathroom.
• Take out all garbage, food (opened and unopened) and empty the dishwasher before check-out.
• Close all doors and windows on your day of departure.
POSSESSIONS
Any personal items or possessions that are left at the Accommodation are not the responsibility of the Host. The Host shall make every reasonable effort to return the item to the Guest. If claims are not made within the law’s required time period or two (2) weeks, whichever is shorter, the Host shall be able to keep such items to sell or for personal use.
CANCELLATION AND ALTERNATIVE ACCOMMODATION
If, for whatever reason, The Andalusian has to cancel a booking of a specified accommodation at any time after confirming a booking or should the accommodation, for whatever reason, be unavailable on the day that the holiday starts, then The Andalusian will offer the guest(s) the choice of:
A: Another alternative accommodation (subject to availability).
B: A full refund of the amount paid by the guest(s) to The Andalusian or the owner.
In such circumstances the guest(s) shall have no further claim against the owner or The Andalusian.
If, for whatever reason, The Andalusian has to terminate a holiday letting at any stage after the letting period has commenced due to reasons outside of the control of The Andalusian or the owner (for example because of flood, fire, storm or other damage to the accommodation, failure of equipment or services serving the accommodation) then The Andalusian will offer the guest(s) the choice of:
A: Another alternative accommodation for the remainder of the original letting period (subject to availability}
B: A refund of part of the amount paid by the guest(s) to The Andalusian in relation to the relevant accommodation (which shall be calculated on a pro rata basis proportionate to the number of days in respect of which the holiday letting is terminated).
In such circumstances the guest(s) shall have no further claim against the owner or The Andalusian.The guest(s) should note that the option of an alternative accommodation (if one is available) may be subject to an additional payment by the guest(s) (where the alternative accommodation is let at a higher price than the original accommodation); moreover, the guest(s) must accept that any alternative accommodation will be different from the original accommodation and may not have the same facilities (or location) as the original.
REPAIRS - MAINTENAN
The guest(s) agrees to allow employees from The Andalusian to enter the accommodation (having given notice where possible) to arrange any necessary repairs our maintenance at the accommodation, garden or swimming pool. Although The Andalusian and/or the owner will use their best endeavors to foe any broken domestic appliances or other equipment contents as soon as possible, the guest acknowledges that due to the limited period of renting the accommodation, it may not be possible to repair such items during the period of stay.
WI-FI
The Internet connection on the Costa del Sol is in some cases not as fast and stable as in most of the northern European countries. Not all accommodations have the possibility to have a landline with ADSL or Glass fiber and are therefore use an internet connection through an antenna or satellite. These Internet connections usually have a download speed of up to 3MB and 1 MB of upload speed. Also, there is sometimes a limit of up to 20 or 30 GB per month. In most cases, the Internet is good to use for surfing the Internet and using social media and email but not for downloading large amounts of data such as movies, etc. While accommodation owners do all within their power to ensure Wi-Fi is available at all times, we cannot guarantee continuous connection to the Internet. If access to Wi-Fi is crucial during your holiday, please check with us before booking.
PETS
Pets are welcome in a selection of our rental accommodations. If pets, in exceptional cases, where agreed in advance by the Host (for example in the case of registered guide dog or large dogs) Guest(s) are charged at € 50,- per pet per booking. The payment should be made to us at the time of booking or latest before check-out. Pets are only accepted under the strict understanding that:
• Pets are never left alone in the accommodation.
• Uninterrupted barking for longer periods which cannot be contained by the owner after warnings, can result in the termination of your rental agreement.
• Pets are kept under control at all times.
• Pets are kept on a leash at the communal areas at all times.
• You bring bedding and food bowls for your pets.
• Pets are not permitted in bedrooms or on furniture.
• Pets are up to date with flea and worming treatments.
• Dogs in Spain must be leased at all times aggressive dogs must wear a muzzle
• You accept total responsibility for your pets and its actions (e.g. cleaning up mess etc.).
• Upon checkout you will leave the accommodation in a clean and tidy condition.
• You respect the additional community rules about pets of the specific accommodation, of which a copy can be found at the accommodation itself.
Failure to comply with any of these points will lead to any additional costs incurred being charged to the Guest(s).
GUEST(S) RESPONSIBILITY
The guest(s) agrees to pay for any breakages, losses, or damage to the accommodation and to take good care of the accommodation and leave all equipment and utensils in a clean and tidy condition at the end of their stay.
LIMITATION OF LIABILITY
The Andalusian, his employees and/or the owner of the accommodation shall not be held responsible for:
1. Any loss of enjoyment or extra expense incurred due to any delays or changes to any flights, travel arrangements or any other service that is beyond their control.
2. Any loss, damage or inconvenience caused by adverse weather conditions, strikes, riots, construction works or other matters beyond the control of The Andalusian or the owner.
3. Any temporary defect or stoppage of heating, air conditioning, internet connection, electricity, water, gas, or other public facilities.
4. Any loss due to cancellation by the guest other than specified in the cancellation fees.
5. Any damages or compensation, other than the refund of payments already made, in case the accommodation is not available on the booked dates as described in the alternative accommodation
6. No responsibility can be taken for any loss or damage to any motorized vehicle and/ or its content, which are stored onsite of the accommodation. The Andalusian does not accept responsibility for any act, neglect or default on the part of the owner or any other person not within The Andalusian employ or otherwise under the control of The Andalusian, nor for any accident, damage, loss, injury, expenses or inconvenience whether to person or property which the guest( s) may suffer or incur arising out of or in any way connected with the rental unless The Andalusian is directly responsible.
The Andalusian has used his best endeavors to ensure accuracy of all supplied information and details of the accommodation, on the website or in any other written or verbal communication, but no warranty is given as to their accuracy and The Andalusian does not accept any claims resulting from information given or statements made whether orally or in writing.
RESERVATION
Upon signing this agreement, the guests will pay the first 50% of the total rental fee via a first digital payment link. The remaining 50% of the total rental fee will be send to you for payment via an email 7 days prior to your arrival, with a second payment link.
